Welcome to Ruby. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Ruby ("Company," "we," "us," or "our") governing your access to and use of the Ruby mobile application and related services (collectively, the "Service"). Please read these Terms carefully before using our Service.
By downloading, installing, accessing, or using Ruby, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
These Terms incorporate by reference our Privacy Policy and Data Processing Agreement, which together govern your use of the Service. By accepting these Terms, you also agree to the terms set forth in those documents.
Your continued use of the Service following any modifications to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
Ruby is an AI-powered voice and text assistant application designed for iOS. The Service is provided on an "as is" basis and includes, but is not limited to, the following features:
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice. We do not guarantee that the Service will always be available, uninterrupted, or error-free.

You must be at least 17 years of age to use Ruby, consistent with our App Store age rating. Users in the European Union must be at least 16 years of age. By using the Service, you represent and warrant that you meet the applicable age requirement.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities, at our sole discretion and without prior notice.
Ruby offers both free and premium subscription tiers:
All subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your Apple ID Settings (Settings > Apple ID > Subscriptions) or by contacting support@luna-utk.com. Cancellation takes effect at the end of the current billing period.
For subscriptions purchased through Apple In-App Purchase, refund requests are handled by Apple through reportaproblem.apple.com. For subscriptions purchased via Stripe, refund requests may be submitted within 30 days of the transaction.
The Restore Purchases feature is available within the app to recover previously purchased subscriptions on new or restored devices.
We reserve the right to change subscription pricing with 30 days advance notice. Price changes will not affect active subscription periods.
The free tier of Ruby includes the following limitations:
Ruby Pro unlocks the full capabilities of the Service, including unlimited conversations, all device actions, premium workflows, AI coaching, iOS Shortcuts, Agent Planner, Developer Platform, and all other premium features.
We may offer free trial periods for Ruby Pro from time to time. Trial terms will be clearly communicated before activation. Free trials automatically convert to paid subscriptions at the end of the trial period unless cancelled at least 24 hours before the trial expires.
Ruby requires explicit user consent for AI data processing, obtained through our Data Processing Agreement presented during initial setup.
By providing consent, you authorize the following data processing activities:
You may withdraw your consent at any time through the app Settings. Withdrawal of consent will disable AI-powered features but will not automatically delete previously processed data. You may re-consent at any time to restore AI functionality.
You agree not to use Ruby for any purpose that is unlawful, harmful, or prohibited by these Terms. Specifically, you shall not:
We reserve the right to investigate suspected violations and may take action including suspension or termination of your account, and reporting to law enforcement authorities where appropriate.
AI-generated content may contain errors, inaccuracies, or hallucinations. Always verify important information independently.
Ruby uses artificial intelligence to generate responses, suggestions, and content. You acknowledge and agree that:
Ruby includes a memory system that enhances your experience through personalization:
Memories are extracted from your conversations when Ruby identifies relevant personal preferences, facts, or context. Each memory is acknowledged when created, giving you visibility into what is stored.
You maintain full control over your memories:
Stored memories are included in AI prompts sent to Anthropic to provide personalized responses. Memories are not shared with any other parties or used for purposes beyond Service personalization.
Do not share sensitive information such as passwords, Social Security numbers, or financial account numbers in conversations. While memories are secured, this information should not be stored in AI systems.
Ruby provides 120+ device actions across 40+ applications on your iOS device.
Auto-Execute is a configurable feature that controls how device actions are processed:
We recommend keeping Auto-Execute disabled for sensitive actions such as messaging, email, and financial transactions.
You are solely responsible for all results of device actions, whether executed manually or through Auto-Execute mode.
Device permissions (microphone, contacts, location, notifications, etc.) are requested individually as needed and can be managed through iOS Settings at any time. For iOS Shortcuts integration, you are responsible for the behavior and consequences of any shortcuts you install or execute.

We are not responsible for the availability, content, privacy practices, or functionality of any third-party services. Your use of third-party services is governed by their respective terms and policies. Ruby is not affiliated with, sponsored by, or endorsed by any third-party service providers.
Ruby offers 18+ pre-built automated workflows that execute multiple sequential steps to accomplish complex tasks.
The Developer Platform allows users to create custom actions and integrations. You are solely responsible for any custom actions you create or deploy. We reserve the right to remove custom actions that violate these Terms or pose security risks.
We assume no liability for unintended consequences resulting from workflow execution, whether from pre-built or custom workflows.
Ruby, including its design, features, code, graphics, and branding, is owned by Ruby and is protected by applicable copyright, trademark, patent, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.
You retain ownership of all content you submit through the Service. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing and improving the Service. This license terminates when you delete your content or account.
We make no ownership claims over AI-generated outputs and provide no warranties regarding the intellectual property status of such outputs. You are responsible for ensuring your use of AI-generated content complies with applicable laws.
Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without obligation or compensation to you.
Your privacy is important to us. Our Privacy Policy, incorporated herein by reference, describes how we collect, use, store, and protect your personal information.
By using the Service, you consent to:
The Privacy Policy is accessible from within the app Settings. The Data Processing Agreement is required for the use of AI-powered features and must be accepted during initial setup.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUNA AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
Our total aggregate liability to you for all claims arising from or relating to these Terms or the Service shall not exceed the greater of (a) the total amount paid by you to us during the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law. Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
You use the Service at your sole risk. Some jurisdictions do not allow the disclaimer of implied warranties, in which case the foregoing disclaimers may not apply to you to the extent prohibited by applicable law.
You agree to indemnify, defend, and hold harmless Ruby, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, at our sole discretion.

We reserve the right to modify these Terms at any time. Changes will be communicated through:
Material changes to these Terms will be provided with at least 30 days advance notice before taking effect. Non-material changes may take effect without advance notice.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the modified Terms. If you disagree with any changes, you must stop using the Service and delete your account.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal proceedings shall be brought exclusively in the state or federal courts located in San Francisco County, California.
Before initiating any formal legal proceedings, you agree to first contact us at legal@luna-utk.com and attempt to resolve the dispute informally for at least 30 days.
CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of any class, consolidated, or representative action.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy and Data Processing Agreement, constitute the entire agreement between you and Ruby regarding the Service and supersede all prior agreements, understandings, and communications.
